AI & Content Responsibility

This Addendum establishes responsibilities and safeguards relating to customer-supplied references, product images, real people, intellectual property, AI-generated outputs, advertising claims and other materials processed through AI-assisted creative workflows.

Core principle:

AI PRODUCTIONS may assist with creative production, but the customer remains responsible for confirming that customer-supplied materials, references and instructions may lawfully be used for the requested purpose. AI-generated content must also receive appropriate human review before consequential commercial publication or distribution.

Purpose & Scope

This Addendum governs customer responsibility for materials, instructions and references supplied for use in AI-assisted production through AI PRODUCTIONS.

It is intended to operate together with the Master Terms, AI PRODUCTIONS License Agreement, applicable License Schedule and Privacy Policy.

Where the customer purchases an AI PRODUCTIONS license, only the License Schedule corresponding to the plan actually purchased applies to that customer’s license.

Customer Rights & Authorization

By supplying content, references or instructions to AI PRODUCTIONS, the customer represents that it owns, controls, licenses or is otherwise authorized to use those materials for the requested purpose where such authorization is legally required.

The customer must not intentionally submit material for a commercial use that it knows it has no lawful right or permission to make.

Supplying a reference does not transfer ownership.

A customer may only authorize AI PRODUCTIONS to process rights the customer actually possesses or is otherwise lawfully entitled to use.

Product Images & Canonical Product References

Customers may supply product images or other authoritative visual references for the purpose of improving product fidelity, consistency and creative accuracy.

AI PRODUCTIONS may analyze authorized product references to preserve characteristics such as:

  • product shape and proportions;
  • materials and visible texture;
  • construction details;
  • colors and variants;
  • packaging;
  • visible design elements;
  • other commercially relevant product characteristics.

The customer is responsible for ensuring that supplied product imagery may be used for the requested commercial or operational purpose.

Where product fidelity is important, authoritative visual product references should take priority over unsupported textual assumptions.

Photographs, Videos & Real People

If a customer submits photographs, videos or identity references depicting a real person, the customer represents that it has any consent, license or other authorization legally required for the intended use.

The customer must not knowingly submit another person’s identity for unauthorized deceptive, defamatory, exploitative or unlawful use.

Important:

The technical ability to process an image does not establish a legal right to use that person’s identity, likeness, photograph or video.

Models, Likenesses & Identity References

The customer is responsible for determining whether a supplied model image, likeness or identity reference may lawfully be used for the intended purpose.

Depending on the use case, authorization may be required for use as:

  • a commercial model reference;
  • an identity-consistency reference;
  • a creative or stylistic reference;
  • an advertising asset;
  • a customer or brand representative.

AI PRODUCTIONS does not independently create legal consent simply because a reference has been uploaded to the workflow.

Trademarks, Logos & Brand Assets

A customer may provide logos, trademarks and brand materials when it has authority to use them for the requested purpose.

Processing or displaying a third-party trademark through AI PRODUCTIONS does not transfer trademark ownership or create independent rights in that mark.

Customers are responsible for ensuring that their commercial use of brand assets complies with any applicable permissions, licensing requirements or brand restrictions.

Copyrighted Material & Creative References

Customers must not knowingly instruct AI PRODUCTIONS to unlawfully reproduce, distribute or commercially exploit protected third-party material where the customer lacks the rights required for that use.

Creative references may assist with general direction, but the customer remains responsible for whether a requested use of protected source material requires authorization.

Materials potentially affected by copyright may include:

  • photographs;
  • videos;
  • illustrations;
  • music;
  • graphics;
  • advertisements;
  • written works;
  • other creative assets.

AI-Generated Outputs

AI-generated content can contain technical or creative imperfections.

Potential issues may include:

  • incorrect product details;
  • inconsistent proportions;
  • incorrect anatomy;
  • visual artifacts;
  • unintended text or symbols;
  • unintended similarities;
  • hallucinated details;
  • other inaccuracies.
Generation does not equal approval.

The existence of an AI-generated image, video, text or other output does not by itself mean that the output is accurate, lawful, commercially suitable or approved for publication.

Product Accuracy & Commercial Fidelity

AI-generated representations of products may contain inaccuracies.

Where product fidelity is commercially significant, customers should use appropriate authoritative references and review outputs against those references before publication.

Product identifiers such as SKUs, product IDs, variant IDs, filenames, URLs or textual descriptions may help organize a workflow, but such metadata does not independently guarantee visual accuracy.

Visual product truth should be established from authorized, authoritative product references whenever accurate visual representation is required.

Commercial Claims & Product Information

The customer is responsible for the factual and legal accuracy of advertising or commercial claims it supplies or approves for use.

Such claims may include:

  • pricing and discounts;
  • product composition;
  • performance claims;
  • comparative claims;
  • health or wellness claims;
  • warranties;
  • shipping statements;
  • availability or promotional statements.

AI PRODUCTIONS must not be relied upon as independent legal or factual verification of a customer-supplied commercial claim.

Human Review Requirement

AI-assisted production should include human review appropriate to the intended use.

Where AI PRODUCTIONS marks material as READY FOR HUMAN REVIEW, that status means the production is ready to be inspected.

It does not automatically mean that the production has been approved for:

  • public advertising;
  • commercial distribution;
  • client delivery;
  • final campaign deployment;
  • other consequential use.

Prohibited & Deceptive Use

AI PRODUCTIONS must not knowingly be used to facilitate unlawful or intentionally deceptive conduct.

Prohibited uses may include:

  • fraud;
  • unlawful impersonation;
  • unauthorized deceptive identity use;
  • deliberate intellectual-property infringement;
  • defamatory or illegal misuse of a person’s likeness;
  • fabrication of knowingly false commercial evidence;
  • other unlawful or prohibited conduct.

Third-Party AI & Creative Services

AI PRODUCTIONS may depend on or interoperate with third-party AI models, image-generation services, video systems, storage providers, productivity platforms or other connected services.

Those third-party services may have their own terms, restrictions, data practices and content policies.

The customer remains responsible for maintaining any third-party accounts, rights or permissions required for the customer’s own use of those services.

Allocation of Responsibility

Customer responsibility Rights to supplied materials, authorization of references, factual commercial claims and final review of customer-approved outputs.
Workflow responsibility Operating according to configured safeguards, licensed workflow rules and available technical controls.
Human responsibility Reviewing AI output before consequential commercial publication where review is required.
Third-party responsibility External providers remain responsible for their own platforms, systems, services and contractual obligations.

Nothing in this Addendum is intended to transfer responsibility for conduct that applicable law assigns to another party.

This Addendum forms part of the legal framework for AI PRODUCTIONS and should be read together with:

  • Master Terms;
  • AI PRODUCTIONS License Agreement;
  • the License Schedule corresponding to the purchased plan;
  • Privacy Policy.
